SaaS taxability by product type and state (2026)

Last updated · Rules verified against official state sources

Quick Answer:

"SaaS" covers several products, and states tax them differently. Hosted SaaS is taxable in 21 states and DC, with California and Colorado joining on January 1, 2027. Downloaded software is taxable in 38 of the 51, API and AI access in 25, cloud infrastructure in 11, and setup and training in 17, often only when they aren't billed separately. Counts include taxes that start in 2027.
